Have you tried Bobo’s oat bars? Many consumers eat this product believing that it is healthy and good for their balanced diet (as advertised on their packaging). But the truth is that it is a processed food with high amounts of sugar per serving. And that is exactly what the class action lawsuit against Simply Delicious Inc. claims. This lawsuit, led by Christina Hankins and Dimari Benavidez, brought the company to the U.S. District Court for the Southern District of California on July 9th.

The plaintiffs accuse the company of violating state consumer laws by using misleading marketing, promoting their product as healthy, when the amounts of sugar it contains are quite high. According to Hankins and Benavidez, Simply Delicious has unjustly enriched itself and violated the California Consumer Legal Remedies Act. This is why they demand a jury trial, precautionary measures and declarations, and compensation for damages to the participants in the lawsuit and themselves.

Simply Delicious Inc.

Founded in 2003 following the family tradition from mother to daughter, Bobo’s is based in Boulder, Colorado, United States. It is an American brand of oatmeal bars and other baked goods. According to its website, it defines itself as a company with a simple and healthy focus, offering products with those characteristics. Among its product catalog are oatmeal bars, oatmeal bites, and PB&Js, made with high-quality, locally sourced ingredients according to the brand.

Bobo’s class action lawsuit

The Bobo’s brand is facing a class-action lawsuit brought by plaintiffs Christina Hankins and Dimari Benavidez. The lawsuit claims that the brand is irregularly advertising its PB&J oatmeal bars in strawberry and grape flavors. According to the packaging, it is marketed as a healthy product that helps achieve physical well-being. Nothing could be further from the truth, as the bars contain 15 to 16 grams of added sugars per serving.

The lawsuit was filed by Hankins and Benavidez against Simply Delicious in federal court in California on July 9, 2025. According to the lawsuit, the company is violating state consumer laws, and the plaintiffs explain it as follows: “Bobo’s employs a marketing strategy designed to give consumers the misleading impression that they are healthy or promote good health, physical activity, and well-being”.

What do the plaintiffs claim?

Hankins and Benavidez argue that the packaging of oatmeal bars misleads and confuses consumers. You can read how they claim that it is a healthy, natural food, and they make use of typography, text and colors that indicate to the consumer that it is a healthy product. They add that “Claims such as ‘simple ingredients,’ ‘plant-based,’ ‘vegan,’ and ‘non-GMO’ are meant to convey an impression that the products are ‘natural.'” The plaintiffs convict Simply Delicious of wrongfully enriching itself, and of violating the California Consumer Legal Remedies Act.

What are the plaintiffs asking for?

Hankins and Benavidez demand the judge for a jury trial, and request both precautionary and declaratory measures. Additionally, they seek compensation for the affected and for themselves, for damages and losses. This type of lawsuit is not something new. The brand Nature’s Bakery is also facing a class action lawsuit, led by two residents of California. In this case, it is alleged that, like Bobo’s, the brand advertises its fig bars as a healthy product, when in fact they are processed products with high levels of added sugars. And you?
