Bad news for Nissan, but especially for its customers. The well-known brand is facing a class action lawsuit, in which those affected allege failures in the continuously variable transmission (CVT), specifically in the Nissan Murano and Nissan Maxima models. The company has not acknowledged responsibility for this failure, but is offering several remedies to those affected.

They can choose between an extended warranty, a $500 refund or a $1,500 discount on the purchase of a Nissan or Infiniti. Those affected have to submit the request for the chosen remedy within the available timeframe, so that it does not happen to them like Enzo Biochem, where those affected could not recover anything due to lack of action.

Nissan

Nissan was founded in 1933 in Japan. With its extensive experience in the automotive industry, has managed to position itself among the most recognized brands among users. With a wide range of models, designs and technological advances, Nissan offers affordable products for different pockets, and has adapted to the market to meet the needs of the same, while also putting the focus on the user experience.

Class action lawsuit

Despite its recognition and acceptance, Nissan is facing a more delicate situation. Users of its vehicles have joined in a class action lawsuit in which they demand responsibility for the failure of one of the parts. It concerns Nissan Murano and Nissan Maxima models manufactured between 2015 and 2018. According to those affected, there is a failure in the continuously variable transmission (CVT), affecting their performance.

The most curious thing about these failures, is that all have occurred just at the time when the warranty period expired, so the anger of those affected is even greater. The company has not wanted to acknowledge blame or take responsibility, but has decided to offer a series of compensations to avoid a long and costly trial in the long term.

Nissan Compensation

The company has put three alternatives on the table for those affected to choose from, depending on their needs or preferences.

  1. Extended warranty. If the internal design of the vehicle has not been altered or modified with repairs, the company agrees to extend the warranty up to 7 years or 135,000 kilometers, both for the transmission and other parts. In this way, it offers security to those affected in case that part or any other part presents some type of failure.
  2. Cash refund. If your vehicle and year has such a failure because you have invested in fixing it, you will be able to request full reimbursement of the repairs, provided they have been carried out in an authorized workshop. If not, the reimbursement may be up to $5,000.
  3. $1,500 discount on the purchase of a Nissan or Infiniti.

How do I apply for compensation?

Once you have chosen your compensation, you will need to do the following:

  • Claim. It is mandatory to submit a formal claim, where you attach as much information as possible about the vehicle, the faults, the repairs and your personal details.
  • Choose compensation. In the claim, select the type of compensation you prefer.

Aspects to take into account

The submission of the formal complaint is not only part of the procedure, it is mandatory and essential. It must be submitted fully completed and with the correct accompanying documentation. There are many cases of affected people who have not been able to receive their compensation even though it belonged to them, because this aspect was not taken into account. This happened with the agreement reached with Eso Biochem, where those affected did not recover their losses and did not receive their compensation because they did not present their claims correctly; well filled in and within the deadline.
